The Government has recently launched its Flag It Up campaign and is specifically targeting the estate agency sector.  Estate agents can therefore expect a more rigorous and proactive approach from HMRC in policing requirements in 2019.

The 5th Money Laundering Directive will also be implemented in 2019. This will make Money Laundering compliance mandatory in elements of lettings as well as sales.

HMRC have recently introduced a series of fixed administration fees that will be payable on top of any fines issued.

The current Money Laundering compliance regime significantly extended the requirements on agents in terms of compliance.

The estate agency sector accounted for only 0.2% of suspicious activity reports made in the last 18 months. The focus from HMRC is therefore increasing on the agency sector in regards compliance.

Risk assessments for businesses and as part of customer due diligence on both sellers and buyers are mandatory requirements as are PEPS and sanctions checks.

It is also now a requirement for key personnel in an estate agency business to be approved by HMRC.

Lettings agents, whilst not currently required to register with HMRC or carry out the same customer due diligence (CDD) that sales agents do, still need to be mindful of the Regulations and the Proceeds of Crime Act, particularly in "occasional transaction" cases. This will change under the recently approved 5th Money Laundering Directive.

This pragmatic and practical course will help you comply and keep on top of your obligations.

CONSUMER PROTECTION REGULATIONS 2008

These apply to both sales and lettings. They are wide reaching and challenging to comply with.

The industry is currently paying out £millions in "compensation" for easily avoidable breaches.

National Trading Standards have recently had their funding doubled by Government specifically to better police the estate agency sector.
